These Terms & Conditions apply when you purchase products from TimberCulture Ltd through our website, online ordering app or directly from us.
Please read these terms before placing an order.

2. Our products
We sell products including:
Kiln-dried firewood
Kindling
Firelighters
Other firewood and related products that may be offered from time to time
Product descriptions, quantities, sizes and prices are shown at the time you order.
Wood is a natural product. Individual logs will naturally vary in size, shape, colour, appearance, species and characteristics.
Photographs shown on our website or ordering app are illustrative. Your logs may therefore vary in appearance from photographs while still meeting the product description.
Where a product is described as kiln dried or a particular moisture specification is stated, the applicable specification will be the one shown in the product description at the time of your order.
Nothing in these Terms & Conditions affects your statutory rights.
3. Placing an order
You can place an order using the TimberCulture online ordering app linked from our website.
Please check the details of your order carefully before submitting it, including:
Products and quantities
Delivery address
Delivery date
Contact details
Total price
Payment method
You are responsible for ensuring the information you provide is accurate.
After you submit an order, we will provide confirmation electronically.
An order is accepted when we send confirmation that we have accepted it.
If we are unable to accept your order, we will let you know and refund any amount already paid for that order.
4. Prices
The price displayed when you place your order is the price you will pay, unless there is an obvious pricing error.
Prices will clearly indicate whether applicable taxes and delivery charges are included or added separately before you place your order.
Any applicable delivery charge will be shown before you confirm your purchase.
We may change our prices from time to time, but changes will not affect orders we have already accepted.
5. Payment
Available payment methods will be shown during the ordering process.
Where online card payment is selected, payment is processed securely by Stripe.
TimberCulture does not receive or store your full payment card details where these are handled directly by Stripe.
Where TimberCulture offers cash on delivery, payment must be made when the order is delivered.
We reserve the right to withdraw or change available payment methods for future orders.
6. Delivery area
We deliver within the areas shown in our online ordering system.
Availability and any delivery charges may depend on your delivery location.
If we cannot deliver to the address you provide, we will contact you.
7. Delivery dates
You may select an available preferred delivery date when placing your order.
We will make reasonable efforts to deliver on the selected date.
Where circumstances outside our reasonable control prevent delivery on that date, we will contact you as soon as reasonably possible and arrange an alternative.
Unless we expressly agree otherwise, any delivery time or estimated arrival window is an estimate rather than a guaranteed appointment.
8. Delivery access
You are responsible for ensuring there is safe and reasonable access to the delivery location.
Our delivery vehicles must be able to access and leave the delivery location safely without unreasonable risk of damage to:

People or animals
Please tell us before delivery about any relevant access restrictions, including narrow entrances, low branches, weight restrictions, steep or unsuitable surfaces, locked gates or other obstacles.
Our driver will make the final decision about whether access is safe.
We will not knowingly drive across or onto an area that our driver reasonably considers unsafe or unsuitable.
9. Where we will leave your order
Where reasonably possible, we will place your order at the delivery location agreed with you.
Delivery of bulk bags is subject to safe vehicle access and the practical limitations of the vehicle and unloading equipment being used.
A request to leave a bag in a particular position does not guarantee that we will be able to place it there.
Our driver may instead leave the order at the nearest safe and reasonably accessible location.
Please ensure any requested delivery location is clear and accessible before we arrive.
10. Delivery when you are not at home
If you have authorised us to leave your order without you being present, we may deliver it to the location you have specified where it is safe and reasonable to do so.
Please provide clear delivery instructions when ordering.
We will not leave an order somewhere that our driver reasonably believes would be unsafe or inappropriate.
Once an order has been delivered in accordance with your instructions, responsibility for the goods passes to you.
11. Failed deliveries
If we cannot complete a delivery because:
The delivery information provided was incorrect;
Access was not available;
A gate or entrance was locked;
The delivery location was unsafe;
You did not tell us about a significant access restriction; or
Another circumstance within your reasonable control prevents delivery,
we may contact you to arrange another delivery.
Where we incur reasonable additional costs because delivery could not be completed for one of these reasons, we may charge a reasonable redelivery fee.
We will tell you about any applicable charge before arranging the redelivery.
12. Cancelling an online order
If you are a consumer purchasing online, you may have a statutory right to change your mind and cancel your order.
For goods to which the statutory cancellation right applies, you normally have 14 days after receiving the goods to tell us that you wish to cancel.
You then normally have a further 14 days to return or arrange the return of the goods.
To cancel an order, contact us using the details provided in these Terms.
You do not need to give us a reason for exercising a statutory cancellation right.
Your statutory cancellation rights are subject to the exceptions and conditions provided by law.
13. Cancelling before delivery
If you wish to cancel or change an order before it has been delivered, please contact us as soon as possible.
Where we are able to stop the order before delivery, we will cancel it and refund amounts due.
This does not restrict any statutory cancellation rights you may have.
14. Returns
Because bulk firewood is large and heavy, please contact us before attempting to return an order.
Where you exercise a statutory cancellation right and are responsible for returning the goods, you may be responsible for the direct cost of returning them where the law permits this and we have informed you of that responsibility.
We will explain the practical return arrangements when you contact us.
Any refund due will be made in accordance with your statutory rights.
15. Faulty, damaged or incorrectly supplied products
We want you to be happy with your TimberCulture order.
If goods are faulty, damaged, not as described or otherwise do not conform to your statutory rights, please contact us as soon as possible.
Where appropriate, we may ask you to provide photographs so that we can understand the issue.
Goods supplied to consumers must be:

Nothing in these Terms limits or excludes your statutory rights.
16. Firewood storage and use
Firewood should be stored appropriately after delivery.
We recommend keeping firewood in a dry, ventilated location and protecting it from prolonged exposure to rain and ground moisture.
Once delivered, the condition and moisture content of firewood can be affected by how it is subsequently stored.
Always use firewood, kindling and firelighters appropriately and in accordance with the instructions for your stove, fireplace, appliance or equipment.
Never leave a fire unattended and keep combustible products away from children and animals.
17. Events outside our control
We are not responsible for delays or failures caused by circumstances outside our reasonable control.
These may include severe weather, road closures, vehicle breakdowns, accidents, supply disruption or other events that reasonably prevent us from fulfilling an order as planned.
If such an event affects your delivery, we will contact you and take reasonable steps to minimise the disruption.
18. Our responsibility to you
We do not exclude or limit liability where it would be unlawful to do so.
Nothing in these Terms excludes or restricts liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation; or
Your statutory consumer rights.
We are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
If you are purchasing products wholly or mainly for business purposes, different legal rights may apply.
19. Marketing communications
Where permitted by law, we may send existing customers occasional emails about TimberCulture's own similar products, seasonal reminders and offers.
You will be given the appropriate opportunity to opt out and can unsubscribe from marketing at any time.
Marketing preferences do not affect your ability to place orders or receive necessary order and delivery communications.

We process your personal information in accordance with our Privacy Policy.
Our Privacy Policy explains what information we collect, how we use it, who we may share it with and your rights.
21. Complaints

The Terms that apply to your purchase will be those made available to you when you place your order.
23. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you retain any mandatory rights you have regarding where legal proceedings may be brought.
